TERMS & CONDITIONS
The Website GulfPersonnel.com ("GulfPersonnel") provides recruitment services ("Services") pursuant to the Terms of Use set forth below. By Registering, you will be deemed to have agreed to use the Services in a manner consistent with the terms and conditions stated below and with all applicable laws and regulations.
Modification of Terms of Service
GulfPersonnel™ reserves the right to edit, alter, modify or change these terms and conditions without any prior notice. Users of the website are deemed to have read and accepted the same whenever they use the website.
1. Subscriber Conduct
You agree you are solely responsible for your content and you acknowledge GulfPersonnel™ acts as a passive conduit for the distribution and transmission of your data. You represent and warrant that the content you provide to GulfPersonnel™ :
  1. does not infringe on any third party's intellectual property or proprietary rights or rights of privacy;
  2. does not violate any law, statute, ordinance or regulation;
  3. is not defamatory, trade libelous, pornographic or obscene; or
  4. does not contain viruses or other similar harmful or deleterious programming routines.

If you violate this provision GulfPersonnel™ reserves the right to take such action as it may deem fit including termination of your rights to use the Service and all other remedies available to GulfPersonnel™ by law.
2. Registration Data
By virtue of your registration, you agree to provide GulfPersonnel™ current, complete, and accurate registration information (the "Information ") as prompted and to maintain and update this Information such that it is current, complete and accurate. Your registration grants GulfPersonnel™ the right to claim the Company you represent as a client who is using services offered by GulfPersonnel™. You further grant GulfPersonnel™ the right to disclose, advertise and distribute the aggregate Information including the nature and requirements of the vacancy with or without the name (s) of the Recruiter to third parties including news media, other websites in connection with marketing the Services. Furthermore, GulfPersonnel™ may itself use your individual Registration Data to provide the targeting of advertisements and other Service offers. However, the Company will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent for the purpose of spam or unsolicited marketing collateral.
3. Web Site Security Rules
Users are prohibited from violating accessing data not intended for such user or logging into a server or account which the user is not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Web Site, overloading, flooding, spamming, mail bombing or crashing; (d) sending unsolicited e-mail, including promotions and/or advertising of products or services; or (e) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
4. Monitoring
The Company acts as a passive conduct for the distribution and publication of user-submitted material and has no obligation to screen or monitor said material. If notified by a user of material which allegedly do not conform to these Terms and Conditions, the Company may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. The Company has no liability or responsibility to users for performance or nonperformance of such activities. The Company reserves the right to (a) expel users and prevent their further access to the Web Site for violating these Terms and Conditions or the law, (b) remove communications which are abusive, illegal, or disruptive, or (c) take any action with respect to user-submitted material that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its ISPs or other suppliers.
5. Links to Other Sites
The Web Site contains links or other connections to third party web sites. The Company provides these links only as a convenience to you and does not endorse, and is not responsible for, the contents on such linked sites. Further, The Company is not responsible for any viruses accesses through said third-party. If you decide to access linked third party Web sites, you do so at your own risk.
6. The Company's Liability
The Company does not by this website give any warranty as to the quality, safety or legality of the jobs, resumes or other material posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any resume or material placed by you on the Web Site. Employers are solely responsible for their postings on the Web Site. The Company is not responsible for any material posed on the Web Site that may be offensive, harmful or inaccurate.
7. Assured Response
This program is offered only to clients taking up "Premium" membership to the job portal. The client pledges that it is not a company who activities include Recruitment, Recruitment Consultancy or Secondment/Staff-Contracting/Payrolling. Such companies are not eligible to be covered under the Assured Response program. The Assured Response program is only open to "direct employers". Please note that the Assured Response program only seeks to get sufficient response to the clients requirements. But it explicitly does not GUARENTEE that the response will be sufficient or relevant. In case the client does not find suitable candidates through the job portal - under the Assured Response program, GulfPersonnel™ will see to find the client relevant candidates through physical recruitment services that may be offered at a lower rate to the prevailing market rates. These rates will need to be pre-decided with the client before executing the Assured Response.
8. RSS Feeds
Really-Simple-Syndication is an XML format for deliverying news and other updates to receiving agents. GulfPersonnel.com provides 2 RSS feeds - one for all the HOT JOBS placed on the job portal and another for the new jobseeker registrations. GulfPersonnel™ makes no claim to the accuracy or timeliness of this RSS Feed. It offers this feed as-is and where-is for use by partners and interested parties. This feed is created automatically by a batch process and the company has no obligation to screen or monitor said material. For partner website wishing to hose the HotJobs RSS feed on their website - these partner website must note change the contact of the feed itself in any manner whatsoever. The partner website must also provide attribution to GulfPersonnel.com for this feed and intimate GulfPersonnel™ of any changes to its location on their website. Partner websites must take explicit permission from GulfPersonnel.com to host any content from their RSS feeds and remove the feed immediately on notice from any representative of GulfPersonnel™ to do so without any liability or delay whatsoever.
Email and Communication Services
The job portal offers a way for recruiters to create an email id for every job vacancy posted online and for a way to have emailed resumes forwarded to any email addresses of their choice. GulfPersonnel.com will not be held liable for any emails received through this medium and the information contained in them as it acts as a passive email conduit - forwarding emails received on the job id to the email address listed by the recruiter in the job vacancy, Furthermore the company and has no obligation to screen or monitor said material. There is anti-virus scanning and spam detection in place for each email received by this feature but GulfPersonnel™ claims no competence in this area or any guarantee that viruses and spam will not reach the email address listed by the recruiter against the vacancy.
Member account, password and security
If a particular service offered on GulfPersonnel™ requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You then will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify GulfPersonnel™ immediately of any unauthorized use of your account or any other breach of security. GulfPersonnel™ will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by GulfPersonnel™ or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
Privacy
Except as provided above, GulfPersonnel™ will not intentionally monitor or disclose any private message or address Information unless required by law, regulation or court order. You agree to respect the privacy and confidentiality of others users of the website.
Personal Use & Security
You agree not to resell or make any commercial use of the service without the express consent of GulfPersonnel™ you are entirely responsible for not maintaining the confidentiality of your password and account. You shall be fully liable for all use of the Service, including any unauthorized use of your account by any third party.
Indemnification
You agree to defend, indemnify and hold harmless GulfPersonnel™ its employees, directors, officers, agents and their successors and assigns from and against any and all liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of your account, including any claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights.
Term
This agreement shall continue in full force and effect for so long as you are using the Services. Either you or GulfPersonnel™ may terminate the service at any time, with or without cause by expressly informing the other of the same. All provisions of this agreement which by their nature survive termination shall survive termination.
Disclaimer of Warranties
You expressly agree that the use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. GulfPersonnel™ expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. GulfPersonnel™ makes no warranty that the Services will meet your requirements, or that the Services will be uninterrupted, timely, secure, or error free. Nor does GulfPersonnel™ make any warranty as to the results that may be obtained through the Service or that defects in the software will be corrected. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk and you will be solely responsible for any damage to your computer systems or loss of data that results from the download of such material and/or data. GulfPersonnel™ makes no warranty regarding any goods or services purchased or obtained through the Service or any transaction entered into through the Service. No advice or information, whether oral or written, which you obtain through the Service shall create any warranty not expressly made herein.

GulfPersonnel.com™ and all other trademarks and tradenames appearing on GulfPersonnel™ are the property of GulfPersonnel FZ LLC. GulfPersonnel's trademarks, logos, service marks, and tradenames may not be used in connection with any product or service that is not provided by GulfPersonnel™ or in any manner that is likely to cause confusion, or in any manner that disparages or discredits GulfPersonne FZ LLC or GulfPersonnel. All other trademarks or service marks, brand names, company names and/or logos appearing on GulfPersonnel™ are property of their respective owners.
Miscellaneous
This agreement will be governed by and construed in accordance with the laws of India without giving effect to principles of conflict of laws. The Courts at Mumbai shall have exclusive jurisdiction in respect of any proceedings arising out of this Agreement. Any provision of this Agreement being held to be invalid or unenforceable, shall not in any way affect the validity, legality or enforceability of the remainder of this Agreement. GulfPersonnel's failure or delay to act with respect to the enforcement of the obligations and covenants under this Agreement does not waive its right to act with respect to subsequent or similar obligations or covenants under this Agreement. All rights and remedies existing under this Agreement except as otherwise provided herein are cumulative to, and not exclusive of any rights or remedies otherwise available. This Agreement sets forth the entire understanding and agreement between you and GulfPersonnel™.
Disclaimer
The services, content and information provided on this web site ("GulfPersonnel ") is on an "as is" basis and without warranties of any kind, implicit or explicit, in regard to the accuracy or completeness of such information, including that contained in any referenced links.
GulfPersonnel™ disclaims all warranties, including the warranties of title, merchantability, and fitness for a particular purpose.
EXCLUSION OF LIABILITY
